Generally, simple divorce cases are referred to as 'uncontested' divorces. Here are some of the basic requirements for a 'uncontested' divorce in Colorado:

  • At least one of the spouses must testify that the marriage is 'irretrievably broken.'
  • At least one of the spouses must have been domiciled in Colorado during the 90 days preceding the filing. The intent to reside in Colorado governs the determination of domicile.
  • Colorado requires a 91-day 'cooling off' period between the filing of the marriage dissolution and the entry of the final divorce decree (even if all parties agree).
  • There are no disputes with regards to the property and debt division.
  • There are no contested child custody matters.
